How feasible is it to combine a career in law and real estate brokerage?

I have both a law degree and real estate brokerage. I just finished law school and what I am planning on doing is specializing in estate planning (drafting living trusts, etc.), but also assisting my clients with their real estate needs such as listing and selling their homes, etc. In the part of the country where I live (San Francisco) Real Estate brokerage commisions are still very substantial, and in fact, I would venture to say that I would probably make more money through my real estate services than my legal services if I offered a "one stop shop" sort of business where people go to me for both legal and real estate advice. My question is, how feasible would it be to combine an estate planning legal practice with a Real Estate brokerage servie? Has anyone ever known of an attorney who also did Real Estate on the side? Any thoughts would be greatly appreciate

My mother’s house is in a real estate trust with myself and my sister as beneficiaries. She has just passed away and I am planning on buying out my sister’s half. Will I be eligible for the $8000 tax credit? Also any advice on how to make the process go as smooth as possible? Thanks

reluctant new landlord?

any advice for me i’m goin to have rent my condo in vt and go stay with a friend where i can find work several hours away. I am goin thru a real estate agent ( whom i trust ) as opposed to just listing online in paper does this approach make sense and who usually pays the fee tennant or owner

Plan is to put it up for sale and at same time if rents first the lease til apr and put back on market does this sound valid

150 hour requirement to sit for the Uniform CPA exam and law school?

Hello everyone,

I’m a little confused about the 150 hour requirement to sit for the CPA exam. I’m currently in CA and I know that this requirement isn’t yet the law here, however, I want to meet the 150 hour requirement since it seems to be the profession’s new standard. I know that I can meet this requirement by getting my MS in Taxation after I finish my BS in Accounting but I’m curious about other credits that might meet this requirement. I’ve been considering law school as an option to meet this requirement since I’m interested in the estate and trust areas of tax planning. I just can’t seem to find any information about attending law school to meet this new 150 hour requirement. I’m not even sure that law school would be a good option over getting the MST but it seems that this route could possibly "kill two birds with one stone". Any answers, insight, or advice is greatly appreciated. Thanks.

How Do I legally get this person out of my house?

My father recently passed away on May 15. He had no will and the courts made my brother and I executors to his estate and gave us the house. There is this woman that had lived with my dad for a while as his friend and roommate. She is on no lease, she is not on the deed to the house and hasn’t worked for years. My father had two trusts and one paid his bills for him so he never had to pay anything. The trust was turned over to my brother and I since that was how my grandparents set it up. The utilities have already started to be cut off and the electric will be cut off on July the 1st. My brother left this morning to start a tour of duty in Iraq. He plans on living in the house when he returns and want to stay there when he comes in for leave the first of September. This woman does not want ot leave. How do I get her out? I’m done being nice about it!!! She was only a roomer who mooched off my dad and never had to pay for anything. It’s time for her to go!! She didn’t even check on my dad the day he died!! She left him lay there, in his bed, for 3 hours dead before she checked on him!!! She was in the house all day!!!
Allow me to add that I have no issue giving her more time if that is what she needs. My issue is that she is an alcoholic, just like my dad and has had no job for years. She is an open drug user and took money from my dad all the time. They were not in a relationship. She was only a friend. She has never paid a bill in that house and has no utility with her name on it for that house. She sits around and smokes pot and gets drunk day and night. She can not pay rent or pay to have any of the utilities turned back on! That is my issue!

Can our landlord chuck us out when our tenancy agreement comes to an end?

Our landlord wants to sell the property and the guy at the estate agent in charge of the sale spoke to us and told us that we would automatically go onto a rolling contract where they had to give us 2 months notice and we had to give 1 month, which we were happy with and so said ok, trusting he would sort it all out.

However, it is now 2 weeks before our contract runs out and we had a phone call from the guy who deals with letting, saying that the sales guy was wrong and shouldn’t have got involved and asking us to pay to draw up a rolling contract that goes from any day of the month with 2 months notice from either party. We don’t want to do this, as we plan to move out ASAP, and we would gone anyway at the end of the contract, but we were taking our time as we thought it went onto this rolling one automatically, but now I am worried they can just chuck us in two weeks if we don’t say yes to the new rolling contract.

It doesn’t say anything about the terms of their notice to us in our contract. I know I should have got something in writing sooner, but I didn’t think they would mess us round like this! Any advice is very welcome!

Should I buy a House with my company rather than my own name?

I own a business. A general partnership, to be exact. The partners are all close friends/family. I’m getting ready to purchase a property as an investment (and a source of income as a rental). I plan to pay cash. Would I be better off purchasing it under my name, or under the partnerships. I live in California. And when I say better off, I mean in general regarding tax purposes and ease of transfers. I hear a lot of things about Limited Liability company’s or land trusts as a way to protect property from excessive taxes on transfers and such. Since I allready am in a partnership (though our business is generally not real estate) I wondered if it would be good to handle the rental under it. Also IF I should happen to die, I would like the property to be easily transfered to one of my partners. Thanks for any help you might give.

Inheritance Recieved - Capital Gains Tax Forms not recieved…?

I recieved a small inheritance last year from the death of my grandfather. Apparrently from the time he died to the time of the sale of the real estate he owned, there was a slight appreciation in the house - of which I recieved a cash dispersement from the proceeds. The attorney running the trust is not very responsive and has not sent any tax forms, nor do I believe he plans on it - but I know that I am liable for some tax here. My question is: How long do I need to wait for the forms to be sent before I can file my taxes? If he does not send the forms, is he liable for the tax? What should I do? Thanks!
