Rental advice, ending lease early due to no heating. NSW AUSTRALIA?

On May 21, 2009 / By Estate Planning Help / In Estate-Planning-Forms

Hi, I am after some advice on ending my lease early. I am 2 months into a new lease (been here 8 months). I have a wood heater, which I requested to be cleaned and they found problems-a week ago. So they are planning to put in a split system. On Thursday she asked me not to use the heater- the owners request.

I have 2 young children, 1 with a disability. And I went in on Friday to ask for a estimate on how long it will take. She was very rude. I have told them about 3 times I have no other form of heating. She just said oh well, i dont have a heater to give you, use doonas. Its like if A/C breaks down in summer (use fans).

I was just wondering where I stand as I have been told they must supply heating. The real estate are the worst I have ever seen. And I am paying $250 per week (country town avg rental $230/3br, avg price has gone down since I signed new lease, even though they upped it $20wk when I signed new lease) The house is in poor condition too. So I would like to end my lease early but dont know where i stand.

Thank you for any help you can give.

EDIT:Do you know how long they legally have to fix the heater before I take any action?

Well - I’ve heard that NSW was the frontier but that’s’ just insane. Where ever you live in an english speaking world, certain laws must be upheld. Please consult w/your town, village, parish, city, country or civil authorities about the conditions under which you must live. It is against the law to rent a apt/townhouse without proper heating - talk to someone at the Police dept to find out who takes the reports. Make the report, and take a copy to your Landlady, she’ll have to comply with the repairs within (I’m guessing here) 72 hours.

To end your lease you must give 21 days notice with reason as your 2 months into the new lease, but if your lease expires in 2weeks prior to renewal you must give notice.

In the case of an emergency you have $1000 your allowed to spend on repairs and the landlord has 3 days to reimburse you, however in your case your landlord seems like the type that wont reimburse you so i would take it up with the Consumer Trader Tenancy Tribunal or even speak to somebody at Department of Fair Trading.

    Hope you get things sorted
